Terms of Service

1. Acceptance of Terms
By accessing or using HomePaws (homepaws.in and associated mobile applications), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the platform.
Your continued use of HomePaws after any changes to these Terms constitutes acceptance of those changes.
2. Eligibility
You must be at least 18 years of age to create an account and use HomePaws. If you are registering on behalf of a minor who requires pet-care services, verifiable parental consent is required as specified under the Digital Personal Data Protection Act, 2023 (DPDP Act).
By creating an account, you represent and warrant that you meet the eligibility requirements above.
3. Account Responsibilities
- You must provide truthful, accurate, and complete information when creating your account and at all times thereafter.
- Your account is for single-user use only. You must not share your login credentials or OTPs with third parties.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@homepaws.in if you suspect unauthorised access to your account.
4. Nature of the Service
HomePaws is a pet super app in the making that provides pet care services. Services are delivered at your home by HomePaws's trainers and by partner providers engaged and vetted by HomePaws. HomePaws Private Limited is the service provider and the merchant of record for every booking made through the platform.
The contract for the delivery of any pet-care service is between you and HomePaws. HomePaws stands behind the quality of services delivered through the platform, subject to the limitation of liability in these Terms.
HomePaws appoints a Grievance Officer per the Consumer Protection (E-Commerce) Rules, 2020 and the Digital Personal Data Protection Act, 2023. Contact details are in Section 18 of these Terms and on our Contact page.
5. Trainer and Provider Vetting
HomePaws engages every trainer and partner provider through its own vetting process. Vetting may include identity verification, credential review, force-free methodology screening, and ongoing performance monitoring. HomePaws sets the standards of care that every provider must follow.
HomePaws exercises reasonable care in vetting and supervising the trainers and partner providers who deliver services through the platform. HomePaws's aggregate liability for any individual service is limited as set out in the limitation-of-liability section of these Terms. Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.
6. User Obligations
You agree not to:
- Use HomePaws for any unlawful or fraudulent purpose.
- Provide false information about your pet, your premises, or your identity.
- Harass, abuse, or threaten any service provider or HomePaws staff.
- Attempt to circumvent the platform by transacting directly with providers discovered via HomePaws, in violation of our service terms.
- Engage in any activity that could harm animals, providers, or the platform.
7. Booking and Payment Terms
Full payment upfront
All bookings require full payment at the time of booking. There are no deposits, partial payments, or pay-later options. Payment is processed securely via Razorpay.
Payment processing
HomePaws uses Razorpay as its payment processor. By completing a payment, you agree to Razorpay's terms of service. HomePaws stores only transaction references (order ID, payment ID, amount, status) — no card or UPI data is stored on HomePaws servers.
Cancellations and refunds
Cancellation and refund terms are governed by our Cancellation Policy and Refund Policy, which form part of these Terms.
8. Intellectual Property
The HomePaws name, logo, and all platform content (excluding user-uploaded content) are the intellectual property of HomePaws Private Limited. You may not reproduce, distribute, or create derivative works without written permission.
By uploading content to HomePaws (pet photos, reviews, chat messages), you grant HomePaws a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating and improving the platform.
9. Termination
HomePaws may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or service providers.
You may close your account at any time by contacting support@homepaws.in. Pending bookings and applicable refunds will be processed per our Cancellation and Refund policies.
10. Disclaimer of Warranties
HomePaws is provided on an as-is and as-available basis without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.
HomePaws exercises reasonable care in selecting, vetting, and supervising the trainers and partner providers delivering services through the platform. HomePaws's warranties for service quality are limited as set out in these Terms; nothing limits warranties or liability that cannot be excluded under applicable Indian law (including the Consumer Protection Act, 2019).
11. Limitation of Liability
To the maximum extent permitted by applicable law, HomePaws Private Limited's total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the amount you paid for the specific booking giving rise to the claim.
HomePaws is not liable for indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or damage caused by third-party service providers.
12. Indemnification
You agree to indemnify and hold harmless HomePaws Private Limited, its directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, your breach of these Terms, or your violation of any applicable law.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore Urban, Karnataka, India.
14. Dispute Resolution
Before initiating formal proceedings, both parties agree to attempt resolution through good-faith negotiation (30 days). If unresolved, the dispute may be referred to mediation. If mediation fails, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, Karnataka.
15. Changes to These Terms
HomePaws may update these Terms from time to time. Material changes will be communicated via email and/or in-app notice at least 7 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
16. Services Delivery
Service delivery terms — including service area, confirmation, and delays — are described in our Services Delivery Policy.
17. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the DPDP Act 2023.
